Culik Law Files FDCPA Lawsuit Against Debt Collectors Atlantic Credit & Finance, Capital Manage
In Boston federal court, Culik Law filed a new lawsuit against the debt collectors Atlantic Credit & Finance, and Capital Management Services for violation of the federal Fair Debt Collection Practices Act, 15 U.S.C. 1692.
The basis of the lawsuit is that the debt collectors attempted to collect on a credit card account which had been ruled uncollectable.
Specifically, the lawsuit alleges that the debt collections violated multiple sections of the FDCPA, including:
Attempting to collect on a debt that was not valid as a matter of law,
Falsely representing the amount of a debt,
Contacting a consumer who was known to be represented by an attorney, and
Refusing to provide documentation of a debt.
Under the Fair Debt Collection Practices Act, a consumer may be entitled to actual damages, up to $1,000 in statutory damages, costs, and attorney fees.
