Culik Law Files Federal Lawsuit Against Bank, Credit Bureaus, for Loan Modification and Credit Repor
Today, Attorney Josef C. Culik of Culik Law PC filed a lawsuit in federal court on behalf of Massachusetts homeowners against a major national mortgage servicer, Suntrust Mortgage, for its breach of a loan-modification agreement and wrongful initiation of foreclosure proceedings against the plaintiff-homeowners.
Suntrust offered the homeowners a loan modification, but when they began making payments Suntrust refused to honor it and instead began to foreclose.
The lawsuit also included claims under the Fair Credit Reporting Act, 15 U.S.C. 1681, against the three major consumer credit-reporting agencies, Equifax, Experian, and Trans Union, because they “refused to correct” the homeowners’ credit reports, inaccurately reporting the mortgage as in default when in fact the homeowners had made all payments under the loan modification.
The case was filed in the U.S. District Court for the District of Massachusetts on September 6, 2011, and has case number 1:11-cv-11562.
