Culik Law Obtains Judgment Against Foreclosure Firm Shechtman Halperin Savage, LLP
After filing a lawsuit on behalf of a Massachusetts homeowner against the foreclosure law firm Shechtman, Halperin Savage, LLP, Culik Law has obtained a judgment.
The lawsuit alleged that the law firm violated the federal Fair Debt Collection Practices Act by attempting to foreclose when it had no right to do so. The suit claims that the wrong bank was identified in the firm’s foreclosure notices, which violates the prohibition under the FDCPA that a debt collector may not use false or deceptive means to collect a debt, or threaten to take action that cannot legally be taken.
In a motion filed in the court, Shechtman Halperin Savage LLP did not deny sending the notices, and stated that an “error” was made; however, it denied being legally liable. The court ordered judgment in the amount of $10,000.
