Culik Law Sues Debt Collector Howard Lee Schiff PC for FDCPA Violations
Culik Law has just sued the debt collector Law Offices Howard Lee Schiff, PC for violations of the Fair Debt Collection Practices Act, 15 U.S.C. 1692. In the lawsuit, filed in Massachusetts federal court, Schiff is alleged to have committed numerous unfair and deceptive practices in connection with knowingly trying to collect on a debt that had already been paid.
The complaint states that the debt alleged had previously been paid off, but that when the consumer told Schiff about this, Schiff nonetheless kept collecting on the debt and tried to obtain a judgment against the consumer.
Furthermore, Schiff is alleged to have misrepresented the amount owed and to have continued collection efforts after the consumer requested proof of the debt. The case has docket number 1:11-cv-11902.
Law Offices Howard Lee Schiff, PC has previously been sued multiple times for other alleged debt-collection violations.
Under the FDCPA, a consumer is entitled to up to $1,000 in statutory damages, plus any actual damages that they suffered, such as emotional distress.
