What Should You Do if You Were Subject to Collection by Ratchford Law Group?

Ratchford Law Group

Who is Ratchford Law Group? Our office has represented consumers who were sued or collected from by Ratchford Law Group, a debt collection law firm. We have created this article to give some basic information about this firm. It is represents creditors, mostly against consumers. It operates in multiple states and has an office in Massachusetts.

Ratchford Law Group is owned and managed by Attorney Michael Ratchford. The firm’s web site states that Ratchford Law Group “assisting national debt buyers and collection agencies in recovering and managing their outstanding accounts receivable … and now has relationship representing direct creditors.” Attorney Ratchford is a member of the National Creditors Bar Association, which is the trade association that represents debt-collection attorneys.

The firm states that it complies with consumer protection regulations. Some of the main consumer protection laws in Massachusetts are the Fair Debt Collection Practices Act, 15 U.S.C. § 1692, et seq., the Consumer Protection Act, G.L. c. 93A, the Debt Collection Act, G.L. c. 93, § 49, the Massachusetts Attorney General’s debt collection regulations, 940 C.M.R. § 7.00, et seq., and the Massachusetts Division of Banks’ debt collection regulations, 209 C.M.R. § 18.00, et seq.

These laws provide a variety of sometimes overlapping protections for consumers against creditors, debt collectors, and debt buyers. For a debt to count as a “consumer” debt entitled to these protections the account generally must have been incurred for family, personal, or household purposes, i.e., not for business purposes.

Ratchford Law Group claims to use skip tracking, credit reports, credit scores, and collection phone calls to collect debts from consumers. In our experience, Ratchford Law Group also files lawsuits against consumers in Massachusetts state courts, which include from Small Claims, District Court, and Superior Court.

If you are subject to collection efforts by Ratchford Law Group, you should contact an attorney to make sure that your rights are protected. The Fair Debt Collection Practices Act was passed because Congress determined that there was abundant evidence that debt collectors use abusive, deceptive, and unfair debt collection practices.

If a debt collector – whether Ratchford Law Group, or another collector – violates any of the above laws, you may have a legal claim. It could also offset any debt that you are alleged to owe (if the debt is valid). Culik Law is a Massachusetts law firm that represents consumers against debt collectors.
